1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the accommodation, dining, wellness, event, and related hospitality services provided by Sattva Greens Eco Retreat, having its address at Sattva Greens Eco Retreat, Survey No. 48/2, Bannerghatta Road, Jigani Industrial Area, Anekal Taluk, Bengaluru, Karnataka 560105, India ("we", "us", "our", or "Sattva Greens Eco Retreat").

By making a reservation, checking in, using our premises or services, or otherwise engaging with us, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with any applicable house rules, booking conditions, policies, and notices communicated to you from time to time. If you do not agree to these Terms, you must not use our services.

These Terms are intended to be read together with applicable Indian laws, including but not limited to the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and other applicable laws, rules, and regulations in force in India.

2. Scope of Services

Sattva Greens Eco Retreat is an eco-hotel offering hospitality and related services, which may include the following:

• Eco-friendly guest rooms with energy-efficient lighting and water-saving fixtures;
• Organic farm-to-table dining using locally sourced ingredients, subject to seasonal availability;
• Guided nature walks, wellness activities, and curated retreat experiences;
• Rainwater harvesting and waste segregation support as part of our sustainability practices;
• Electric vehicle charging access for guests, subject to availability and usage rules;
• Conference and retreat spaces for small groups and corporate offsites;
• Other hospitality, recreational, and ancillary services as may be offered from time to time.

We may modify, suspend, or discontinue any service, amenity, or facility at any time due to operational requirements, maintenance, safety, weather conditions, regulatory requirements, or other reasonable causes. Certain services may be seasonal, capacity-limited, or available only upon prior booking.

3. User Obligations and Responsibilities

By using our services, you agree to:

• Provide accurate, complete, and current information during booking, check-in, and any other interaction with us;
• Comply with all applicable laws, regulations, and local rules while on our premises;
• Respect the property, staff, other guests, wildlife, flora, and the natural environment;
• Use rooms, facilities, and common areas responsibly and only for lawful purposes;
• Follow all safety instructions, signage, and staff directions, including those relating to fire safety, water use, electrical appliances, and outdoor activities;
• Supervise minors and dependents at all times and ensure their safety and conduct;
• Refrain from smoking, vaping, illegal drug use, possession of prohibited items, or any disorderly, abusive, or offensive conduct on the premises;
• Refrain from damaging, removing, or misusing property, fixtures, equipment, plants, or wildlife habitats;
• Use the EV charging facility, if provided, only in accordance with instructions and availability constraints;
• Obtain appropriate travel, medical, and personal insurance where necessary.

You are responsible for any loss, damage, or injury caused by you, your guests, your invitees, or persons under your supervision, whether to our property, staff, other guests, or third parties, to the extent permitted by law.

We reserve the right to refuse admission, suspend services, or require immediate departure from the premises in the event of misconduct, unsafe behavior, non-compliance with these Terms, or any conduct that threatens the safety, comfort, or lawful operation of the retreat.

4. Payment Terms and Conditions

All prices, tariffs, and charges are communicated at the time of booking or otherwise made available by us and are subject to change without prior notice, except for confirmed bookings already paid or guaranteed in accordance with the applicable booking terms.

• Payments may be required in advance, at check-in, during the stay, or at check-out, depending on the booking channel and package selected.
• Taxes, including applicable GST and other levies, shall be charged as per prevailing law.
• Any additional charges for meals, activities, transport, event usage, damages, late checkout, or special requests shall be payable by the guest.
• We may require a security deposit or pre-authorization for incidental charges, which may be adjusted against outstanding dues or damages, subject to applicable law.
• Failure to make timely payment may result in cancellation of the booking, denial of check-in, suspension of services, or retention of amounts already paid, to the extent permitted by law and the applicable cancellation policy.

Unless expressly stated otherwise, all payments are non-transferable and must be made using approved payment methods. You are responsible for any bank charges, currency conversion costs, or payment gateway fees imposed by your financial institution or payment provider.

5. Cancellation and Refund Policy

Our cancellation and refund policy may vary depending on the booking type, season, promotional offer, group size, event package, or third-party booking platform. The specific policy applicable to your reservation will be communicated at the time of booking and shall prevail to the extent not inconsistent with law.

• Standard individual bookings may be cancelled subject to the cancellation window communicated at booking confirmation.
• Late cancellations, no-shows, early departures, and unused services may be charged in full or in part, as specified in the booking terms.
• Refunds, if applicable, will be processed to the original payment method within a reasonable time after verification and deduction of applicable charges, taxes, and administrative fees.
• Promotional, discounted, non-refundable, or advance purchase bookings may not be eligible for cancellation or refund except where required by law.
• Group, corporate, retreat, and event bookings may be subject to separate deposit, milestone payment, and cancellation terms.

We may cancel or modify a booking due to force majeure, safety concerns, operational issues, legal restrictions, or non-payment. In such cases, our liability shall be limited to refunding amounts paid for unused services, if any, subject to applicable law and deductions for services already rendered or costs already incurred.

6. Liability Limitations

To the maximum extent permitted by applicable law, Sattva Greens Eco Retreat, its owners, directors, employees, agents, affiliates, and contractors shall not be liable for:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages;
• Loss of profits, business, revenue, goodwill, data, or anticipated savings;
• Any delay, interruption, or inability to access services due to circumstances beyond our reasonable control;
• Any loss, theft, or damage to personal belongings, vehicles, valuables, or cash, except to the extent caused by our proven gross negligence or wilful misconduct and as may not be excluded under law;
• Any injury, illness, allergic reaction, or adverse outcome arising from guest conduct, undisclosed medical conditions, participation in outdoor or wellness activities, or consumption of food or beverages, except where directly caused by our proven negligence or breach of statutory duty.

Guests are advised to take reasonable precautions for their personal safety and property. Participation in nature walks, wellness activities, and outdoor experiences is voluntary and may involve inherent risks. Guests should assess their own fitness and suitability for such activities and inform us in advance of any medical conditions, allergies, or special requirements.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, wilful misconduct, or any non-excludable statutory liability.

7. Intellectual Property Rights

All content, materials, designs, photographs, logos, text, graphics, menus, branding, website content, digital assets, and other intellectual property associated with Sattva Greens Eco Retreat are owned by or licensed to us and are protected under applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, publish, transmit, display, create derivative works from, or commercially exploit any of our intellectual property without our prior written consent, except for personal, non-commercial use expressly permitted by law.

Any feedback, suggestions, reviews, or ideas submitted by you to us may be used by us without restriction or compensation, subject to applicable law and our privacy obligations.

8. Data Protection and Privacy

We collect, use, store, and process personal data in connection with reservations, guest services, billing, security, legal compliance, and customer support. By using our services, you consent to such processing in accordance with applicable Indian data protection and privacy laws, including the Digital Personal Data Protection Act, 2023, to the extent applicable.

We may collect information such as your name, contact details, identification details, booking preferences, payment information, dietary requirements, and other information necessary to provide services or comply with legal obligations.

• We will use personal data only for legitimate business, operational, legal, and service-related purposes.
• We may share personal data with service providers, payment processors, booking platforms, government authorities, or other third parties where necessary for service delivery, legal compliance, fraud prevention, or security.
• We implement reasonable technical and organizational safeguards to protect personal data, but no system can be guaranteed to be completely secure.
• You are responsible for ensuring that any personal data you provide relating to third parties has been shared lawfully and with appropriate consent where required.

9. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, floods, fire, storms, epidemics, pandemics, government actions, war, terrorism, civil unrest, labor disputes, power failures, internet outages, supply chain disruptions, or transportation interruptions.

In the event of force majeure, we may suspend, modify, or cancel services without liability except to the extent required by applicable law or specifically agreed in writing. We will make reasonable efforts to notify affected guests and, where appropriate, offer rescheduling, alternative arrangements, or refunds in accordance with our policies and legal obligations.

10. Changes to Terms

We may revise, update, or replace these Terms from time to time to reflect changes in our services, business practices, or applicable law. The updated Terms will be effective from the date stated in the revised version or upon publication on our website or communication through other reasonable means.

Your continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services and, where applicable, cancel any future bookings in accordance with the cancellation policy.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection laws and any mandatory legal provisions, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms, our services, or your use of the premises.

Nothing in this section shall limit any rights you may have under applicable consumer protection or other mandatory laws of India.

13. Severability Clause

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Sattva Greens Eco Retreat with respect to the subject matter herein and supersede any prior oral or written understandings to the extent permitted by law.
